BACKGROUND

Dr. Ruth Anyango Aura-Odhiambo is a Founding Partner and Lead Consultant at Odhiambo & Odhiambo Advocates, bringing over 32 years of distinguished experience in legal practice, academia, and policy reform. She is recognized across Kenya and the region for her pioneering work in international human rights law, gender justice, commercial law, and governance reform, as well as her ability to bridge rigorous scholarship with transformative advocacy.

Dr. Aura-Odhiambo holds a Doctor of Laws (LL.D) in International Law from the University of Pretoria, an LL.M from the University of Zimbabwe, a Master in Policy Studies from the University of Fort Hare & University of Zimbabwe, and an LL.B from the University of Nairobi.

A former Dean of the Faculty of Law at Egerton University and Chairperson of FIDA–Kenya, Dr. Aura-Odhiambo has shaped Kenya’s legal landscape through leadership in gender equality, human rights, and institutional transformation. Her stewardship at FIDA–Kenya saw major advances in gender-responsive legislation, access-to-justice programmes, and the integration of women’s rights into national policy frameworks.

She has served as a Member of the National Technical Working Group on Gender-Based Violence and Femicide, where she chairs the Data and Knowledge Management thematic area, steering the creation of evidence-based frameworks for prevention, accountability, and policy coherence.

Her consultancy and advisory work spans the African Union, International Development Law Organization (IDLO), and national and county governments leading projects on law reform, devolution, environmental governance, and institutional capacity building. Her expertise in legal audits, governance frameworks, and data governance continues to shape institutional capacity-building and evidence-driven reform across Africa.

Dr. Aura-Odhiambo’s research in gender, climate justice, and constitutional governance continues to influence national and regional policy discourse. She has authored, edited, and reviewed numerous legal and policy instruments, curriculum frameworks, and academic publications that advance a rights-based approach to development and justice.

A mentor and thought leader, she supervises postgraduate research and advises governments and institutions on strengthening rule of law, ethical governance, and gender mainstreaming in policy implementation.

Environmental, Climate Systems, and ESG Advisory

Dr. Ruth Aura-Odhiambo’s environmental law practice integrates legal, policy, and research expertise on climate justice, sustainability, and governance. She has advised on environmental policy formulation, biodiversity frameworks, forest governance, and community land management.

 

She has consulted for clients in matters arising under the Environmental Management and Coordination Act (EMCA) and the Climate Change Act, and participated in international, regional and national conferences, processes, research and policy formulation teams linking International, Regional and Kenya’s environmental commitments to global frameworks such as the Paris Agreement and the African Charter on Human and Peoples’ Rights. Her work advances ESG (Environmental, Social, and Governance) accountability and the recognition of women’s environmental rights as a justice imperative.

Real Estate, Land, and Conveyancing

Dr. Aura-Odhiambo has extensive experience in land, rates, and conveyancing law. She advises clients on acquisition, development, and transfer of property, conducts legal due diligence and compliance audits, and represents communities and institutions in land adjudication and titling processes.

 

She has participated in land policy reform and the implementation of the National Land Policy (Sessional Paper No. 3 of 2009), with particular focus on gender equity in land ownership and customary tenure recognition.

Advocacy before Superior Courts

Dr. Aura-Odhiambo has argued and advised in landmark matters advancing gender equality, matrimonial property rights, environmental justice, and constitutional interpretation.

She has been in continuous legal practice since 1993 and, as Managing Partner and Lead Consultant at Odhiambo & Odhiambo Advocates, has argued, directed, and advised counsel in a wide range of substantive proceedings before the High Court, Court of Appeal, and Supreme Court of Kenya, as well as in matters engaging regional and international human-rights law.

  • Acted in property and devolution-related appeals involving competing claims to land ownership and unlawful acquisition, where the appellate courts reaffirmed that constitutional protection of property does not extend to unlawfully acquired titles.
  • Provided strategic leadership in public-interest and human-rights litigation integrating CEDAW, ICCPR, and African human-rights instruments into domestic legal reasoning—resulting in precedents that shaped Kenya’s jurisprudence on equality, environmental rights, and due process.
  • Successfully moved a long-dormant family-property appeal to reinstatement after a decade of inactivity, persuading the appellate court to enlarge time and balance constitutional justice against prejudice in succession-related land disputes.
  • Represented a petitioner in a matrimonial-property division dispute, advancing equality within marriage and the recognition of non-financial spousal contributions such as childbearing and domestic work. The Court’s findings reinforced constitutional and international standards of gender equality and later informed national legislative reforms in family and matrimonial property law.
  • Advised and directed counsel in multiple constitutional appeals, securing rulings that clarified jurisdictional thresholds under Article 163(4)(a) of the Constitution and affirmed the Supreme Court’s role as a court of law, not of facts.
  • Represented public institutions and county governments in high-impact constitutional and environmental litigation affirming the State’s duty to delineate forest boundaries, safeguard community land, and comply with the right to a clean and healthy environment. These cases have strengthened enforcement of environmental governance, indigenous rights, and sustainable development obligations.
Traditional Dispute Resolution (TDR) and Customary Justice

A pioneer in integrating traditional dispute resolution (TDR) within constitutional frameworks, Dr. Ruth Aura-Odhiambo has worked with communities, county governments, and policy institutions to harmonize customary justice with statutory law and human rights standards.

Marriages and Family Institutions

Dr. Ruth Aura-Odhiambo has provided advisory and advocacy services on marriage laws, family institutions, and matrimonial property regimes. She was a key contributor to Kenya’s Marriage Act (2014) and Matrimonial Property Act (2013), embedding equality and international human-rights principles into national legislation.
She continues to advise on inter-jurisdictional marriages, certification of no impediment, registration and recognition of foreign marriages, and matrimonial property rights in Kenya and abroad.

As Chairperson of FIDA–Kenya (2012–2016) and earlier as Senior Legal Counsel, she guided institutional strategies, rapid-response mechanisms, and advocacy before UN human rights mechanisms (CEDAW, CSW), embedding gender equality into Kenya’s justice and policy structures.

Founding of FOLLAP

Founder and Director of the Faculty of Law Legal Aid Programme (FOLLAP) at Egerton University—Kenya’s leading university-based legal aid and clinical education model.
